Auctions Cars In New York

Unpaid refund. Should I report to law enforcement? Can I sue?
I bid and won a car on ezsalvage.com. This is company where one can bid on insurance auction cars. I won a car in April, was sent an invoice and paid $10500. These clowns have not sent me the car and Ihave failed to produce a refund of my money. They keep giving me flimsy excuse; Their manager is not around, they are applying for a loan to pay for refunds. I don’t what they did with my money if they didnt provide service? Can I file a criminal report in a new york law enforcement office? Can I sue for my refund and legal cost? Please help. BTW the company is still operating
@ just a thought. Nothin is off. It’s like winning an auction on ebay. You don’t see you item before you pay for it.
I am in North Carolina and the company is in New york. Can I use a NC lawyer?
“PLEASE REMEMBER: THIS IS NOT AN INSTANT PURCHASE. IF YOU ARE THE WINNING BIDDER, WE WILL PURSUE THE PURCHASE OF THIS VEHICLE ON YOUR BEHALF. If you have the highest eligible offer after closing on our Insurance Company vehicle, EZSALVAGE WILL PURSUE THE ACQUISITION OF THIS VEHICLE FROM THE INSURANCE COMPANY UPON RECEIVING YOUR DEPOSIT. If we acquire the vehicle, your purchase is finalized. If we cannot acquire your vehicle, you can leave your deposit for your next offer. ”
That means they will TRY and get the car for you.
Your only hope is to sue them to get your money back. Find out what the small claims limit in your state is. If you are luck it’ll be $10,000 and you won’t need a lawyer, if it’s only $5,000 then see what it’ll cost for an lawyer to sue them.
You might have a lawyer send a letter saying you will be forced to take legal action if they don’t give you a refund. That might be enough to get them to send you back your money.
You really need to stop calling and get serous about getting your money back.
