If you sell an item on ebay with both a buy it now and auction price what final value fee are you charged?

For example, if the auction starts at 35 and the buy it now price is 40. If the buyer buys it at 40, am I charged the FVF as an auction or at a buy it now price?
I don’t think I was clear. what fees will I get charged as a SELLER?

If you chose the buy it now option, you get it for the buy it now price not the auction price. You did not participate in the bidding so you would not get it at the bid price.
