rights of tenants in forclosure?
the rental home is in foreclosure, I was served papers yesterday. I have asked the owner if I can use the guarantee of $ 2000 as the next two months and then pay monthly rent, she told me to talk with the players that I must pay the rent. They say the Florida law against doing this and I have to pay rent as usual. My contract ends in August but I am told that the date of the sale is set for the house within 30 days. How do I get my deposit and what happens if I refuse to pay until my deposit is returned? Is it the only way to get the deposit back, even when used for rent, for the owner to cancel his contract with the rental agents?
You have no rights, a deposit can not be used for rent (yes that is legal) and who continue to live tros to pay the rent. When the house is sold in an auction that you can give as little as 3 days to leave. Instead of fighting for a mute issue, to pay the rent, you need to find a place to live now. Added: refuse to pay, you get to the Court and that is something that will not do what your credit reports will continue to impede another contract elsewhere.
