How to deal with ebay seller who never shipped item.?

I purchased an item from a seller for $750. The seller ended the auction early and sent me an invoice through pay pal. I didn’t actually “win” the auction so I can’t leave negative feedback. I paid through Pay pal using my bank ATM/Visa debit card. He is verified through Pay Pal. I made sure he listed the ebay item number and I entered the description as well under the notes.

Seller claimed to have mailed package on two occassions. First time UPS had the wrong address so it was sent back to him. Then he was out of town for a week. Then was supposed to overnight the package. I asked him for tracking numbers but he never supplied one. Now he hasn’t answered my email for days. I opened a dispute on pay pal and escalated the issue. Unfortunately this is only covered by their “best effort” service which doesn’t insure me at all. Can Pay pal really help at this point? I emailed ebay as well. Does my credit card provide any fraud protection under these circumstances?

You have two options that will give you results:

If it’s been within 30 days, you can open a dispute with paypal with the reason of non-shipment of goods as the basis. The seller must provide a tracking # to prove the item was delivered to you. From what you’ve stated, the seller would be unable to do this as the item was returned to him (tracking will indicate delivery was made back to the origin). Unfortunately, if the seller does not have funds available, paypal will screw you and you will not get a cent back.

The other option is to circumvent paypal entirely and go straight to your credit card provider and open a dispute for non-shipment of goods. They will investigate to the same procedure to gather a valid tracking number. Since that wont happen, your credit card provider will seize the funds directly from paypal so you’re guaranteed to get your money back. Unfortunately, bypassing paypal in this manner violates your user agreement so they can and will ban you for the rest of your life in which case you may not use paypal anymore. It’s best to save this option as the last resort. Note however that under law, you have only 90 days to file a complaint.
