I sold a truck o n eBay and now the buyer is claiming I misrepresented the truck and is going to an attorney.?
Does he have a case? Here is the ad, “Nice truck that has been well maintained mechanically. It does need a new speedo cable and new emergency brake. The interior has no major defects. There is a dent on the passenger rear side where the bumper attaches and the paint is a bit worn on the drivers side and top of vehicle. More pictures provided upon request. Seller reserves the right to end the auction at anytime. All sales final, NO RETURNS. Winning bidder must pay a non-refundable $500 deposit via PayPal within 24 hours of auction close. The remainder balance must be paid within 48 hours. Buyer responsible for pickup or shipping details/costs.” He is now saying that the truck was not what he expected and wants $500 back. He came from out of state to pick it up and test drove the truck and left back to his home.
Don’t worry about it. He bought the truck and now it belongs to him. You can’t take the truck back because you have no idea what he has done with it since.
Some states do have anti-lemon laws, but that only applies to rolling back the odometer, painting the tires, etc.
Just think about how many used car dealers go through this every day, and they never, ever, will take the car back.
